Thank you so much for recent e mail in respect of the above..
Our experience in sourcing HMS into India has sometimes not been as good and fruitful as anticipated. In fact, we have issued workable LC's of 100000 metric tonnes in the last three months alone, and none of the alleged suppliers has been in a position to forward us Performance Bond Guarantees, let alone any talk of actual shipment. Our LC's are established through NAFED, which is a Government of India undertaking. There are number of performance's on our record and we have no problem in sending a letter to your bank regarding our financial capacity, but the workable LC will be established only after the suppliers bank accepts and confirms that on receipt of LC, they will immediately release Performance Guarantee Bond of 2% for the value of LC. Hence the reason we would expect a PBG of 2% of the LC amount.
For this procedure to succeed we would suggest the following:-
1. THE SUPPLIER WILL ISSUE A DETAILED CONTRACT, WHICH WILL BE ACCEPTED BY US, AS THE BUYERS.
2. OUR BANKER WILL SOFT PROBE THE ACCOUNT OF THE SUPPLIER ON A BANK TO BANK BASIS. IF THE CREDENTIALS OF THE SUPPLIER ARE FOUND TO BE ACCEPTABLE, WE WILL SEND A SWIFT MESSAGE FROM OUR BANK TO THE BUYERS BANK, INTIMATING OUR READINESS OF OPENING OF LC, SUBJECT TO THE CONFIRMATION BY THE SELLERS BANK THAT ON RECEIPT OF NON OPERATIVE LC, THE SELLERS BANK WILL ISSUE PERFORMANCE GUARANTEE OF 2% OF LC VALUE, WITHIN 5 WORKING DAYS, AFTER WHICH THE LC WILL AUTOMATICALLY BECOME OPERATIVE.
3. THE LC WILL BE ON 90 DAYS USANCE, AND WILL NOT BE TRANSFERABLE OR DIVISIBLE WHATSOEVER.
4. THE SELLER WILL ALLOW US TO INSPECT THE CARGO AFTER OPENING OF LC.
5. A QUALITY INSPECTION CERTIFICATE OF SGS OR EQUIVALENT HAS TO BE PROVIDED TOGETHER WITH OTHER DOCUMENTS UNDER LC, FOR NEGOTIATION.
If the above procedure is acceptable, we would request you send us your best offer together with photos of the material in question.
